The following are the Terms & Conditions for the Grand Getaways Vacation Travel
Club ("Club") that apply to travel, services, discounts, coupons and other promotions
("Rules and Regulations") offered and/or booked by the Club or Grand Incentives,
Inc., ("GII") for members of the Club ("Club Members").
DEPOSITS AND PAYMENTS: Required deposits and payments are subject
to the terms and conditions of each of the various programs offered as a benefit
of membership in the Club. The Club is not responsible for, nor does it provide
fulfillment services for, any of the travel or vacation discounts and services offered
as a benefit of Club Membership. Furthermore, the Club is not responsible for any
verbal offers or any changes not in writing from its authorized officers or representatives,
and therefore accepts responsibility only for those checks, wire transfers, money
orders, cashier's checks or credit card payments made payable to Grand Getaway Vacation
Travel Club, GII or its affiliates.
PRICES: Prices for travel and other accommodations including, but
not limited to, reservation costs and processing fees, are quoted based on the Club’s
most up-to-date current rates. Prices for such services are subject to change until
such time as the Club Member pays an initial deposit or other required fee in order
to guarantee such services. The Club and/or GII will make every effort to insure
the accuracy of both printed prices and those quoted by telephone; however, the
Club and GII reserve the right to make subsequent adjustments if a price was printed
or quoted incorrectly. Prices quoted include only expenses and items specifically
mentioned, and do not include miscellaneous expenses such as gratuity, food, beverages,
telephone calls or other such incidental costs. Any and all costs or penalties charged
by airlines, cruise lines, condominiums, hotels, car rental companies, and other
providers and suppliers that are related to the Club Member’s travel or accommodation
plans shall be the sole responsibility of such Club Member. In the event a provider
or supplier charges the Club or GII for those costs attributable to the Club Member’s
travel or accommodation plans, the Club and GII reserve the right to charge the
Club Member for payment of those costs, including any incidental charges incurred
by the Club and GII in doing so.
REFUNDS, CANCELLATIONS AND CHANGES: All policies and procedures
regarding refunds, cancellations and changes in the various programs offered as
a benefit of Club Membership are set forth in the Club materials. No refunds will
be made for partially used or unused features or services, including hotel/condominium
accommodations or unused airfare segments. For those products and services which
are fulfilled by the Club or GII, if those products or services are not available
for the dates which the Club Members has a confirmed reservation, then the Club
and/or GII reserves the right to substitute products or services of equal or greater
value or provide the Club Member a refund in the amount of monies paid to either
the Club or GII.
CONFIRMATION PAPERS AND OTHER DOCUMENTS: Documents evidencing confirmation
of travel arrangements will be provided to the Club Member upon payment-in-full
for requested travel and pursuant to the terms and conditions set forth in the various
programs that are provided as a benefit to Club Members. Under no circumstances
should a Club Member depart on vacation before they have received confirmation papers.
When traveling out of the USA , Club Members are required to have certain documents,
such as proof of citizenship (valid passport or an original or certified copy of
their birth certificate) plus a photo I.D. While a Club reservation specialist may
advise Club Members of required documents, responsibility for acquiring and/or providing
said documents is the sole responsibility of each traveler. A Club Member having
questions regarding documentation should contact the consulate of the country to
which travel is planned. No refund will be made to passengers affected by their
failure to possess proper documents.
GENERAL RESPONSIBILITIES: In all instances, the Club and GII are
acting as separate entities from those suppliers providing transportation, accommodations,
cruises, sight-seeing tours, and other discounted programs offered by the Club.
None of these suppliers are agents or employees of the Club and/or GII. All coupons,
receipts, and tickets are issued subject to the terms and conditions specified by
each of the various suppliers. Club Members agree that neither the Club nor GII
shall be held liable for any accident, loss, injury, or damage in connection with
any accommodations, transportation, cruise, or other services resulting directly
or indirectly from any occurrence or condition beyond its control, including defects
in vehicles, breakdown of equipment, strikes, theft, delay, or cancellation of/or
changes in, the itinerary or schedule, etc. If a program or benefit sponsored by
the Club and/or GII becomes unavailable due to a natural disaster, act of God, war,
or insurrection or any other reason beyond the Club's control, the Club member agrees
to waive any and all claims against the Club and/or GII. The Club and GII reserve
the right to decline or accept or retain any passenger at any time. Prices are subject
to change without notice. The terms of this agreement may not be amended except
in writing by an authorized agent of the Club and/or GII. Neither the Club nor GII
assumes responsibility for any errors or omissions in the contents of any advertising
or for losses, damages, or delays caused by sickness, strikes, weather, or any other
acts beyond their control. The airlines and the cruise lines concerned are not to
be held responsible for any act, omission, or events, during the time passengers
are not aboard their planes or ships or conveyances. The passenger tickets in use
by the airlines and the cruise lines concerned, when used, shall constitute the
sole contract between the airline or cruise line and the purchaser of these tickets
and/or the passenger. Any and/or all transportation companies herein mentioned shall
have or incur no responsibility of liability to any traveler aside from their liability
as common carriers. Club Members agree and acknowledge the Club and/or GII shall
not be responsible for any consequential damages and that the sole extent of the
Club's and/or GII's liability shall never exceed the amount actually paid by the
Club Member or traveler to the Grand Getaway or GII.
MEMBERSHIP AND MEMBERSHIP DUES: Only families and individuals are
eligible for membership in the Club. A membership in the Club is transferable for
the lifetime of the Club for a fee equal to the current yearly membership fee at
the time of the transfer. The Club Member must notify the Club, in writing, of its
desire to transfer his or her Club Membership. If a Club Member transfers his/her
membership, the transferee shall be entitled to the use and benefits of the Club
upon receipt by the Club of a properly executed membership transfer application
and the Annual Fee. The Club reserves the right to refuse to accept a membership
transfer application. Annual dues must be paid to ensure Club Members' eligibility
in current and future programs. The Club reserves the right to suspend or terminate,
without further obligation, if a Club Member fails to comply with these Rules and
Regulations or the terms and conditions of any of the Club's many programs and benefits.
LOCATION AND ADMINISTRATION: The Club and GII are located at 9040
Town Center Parkway , Bradenton , FL 34202 . Any action by a Club Member to challenge
or enforce the Rules and Regulations of the Club or the terms and conditions of
any of the Club's programs and benefits shall be exclusively to the jurisdiction
of Manatee County , Florida , USA . By joining the Club, a Club Member agrees to
the personal jurisdiction of these courts. In the event any such action is initiated
by a Club Member, the Club and GII, in defending such action, shall be entitled
to recover all costs including reasonable attorney's fees. The Club and/or GII and/or
any of their subsidiary, agent, or distributor companies expressly disclaim any
and all liability for any claims, damages, losses, penalties, expenses, cost and
liabilities of any kind or injuries resulting from any act or omission of any other
individual or entity providing product and/or services in the programs sponsored
by the Grand Getaways Vacation Travel Club Program.
